Acceptance of Terms
By accessing and using the Kate Wand Vocal Coach website (kate-wand.com) and services, you accept and agree to be bound by the terms and conditions of this agreement. If you do not agree to abide by the above, please do not use this service. We reserve the right to modify these terms at any time. Your continued use of the website following the posting of revised Terms of Service means that you accept and agree to the changes.
Description of Services
Kate Wand Vocal Coach offers the following services:
- Pro Voice Analysis: A one-time, in-depth analysis of a recording you submit, including written notes, a custom exercise video, and access to a private follow-up channel.
- Async Coaching: An ongoing monthly subscription providing recurring vocal analyses, exercise updates, direct messaging access, and Vocal Lounge community access. Subscribers may cancel at any time, with no minimum commitment.
- 1:1 Coaching: Live, structured, ongoing coaching with weekly live sessions on FarPlay, between-session messaging, and a long-term vocal plan. Application required, subject to acceptance at Kate Wand's sole discretion, with a minimum commitment of three (3) months from the start of the engagement.
- Live Session: A one-off live coaching hour on FarPlay, à la carte. Available to current Pro Voice Analysis clients, Async Coaching clients (after three months of subscription), and 1:1 Coaching clients.
- Cohort Programs: Small-group programs combining shared live sessions, deposit-plus-balance billing structures, and bespoke curricula. Application required, subject to acceptance at Kate Wand's sole discretion.
- Vocal Lounge Community: Access to the Vocal Lounge community on Kajabi, included with paid services as applicable.
- Educational Content: Free and premium video content, articles, the free vocal assessment quiz, and other resources related to vocal technique and improvement.
Application Acceptance
Kate Wand reserves the right to decline any application for 1:1 Coaching, Cohort programs, or any other service requiring application or approval, at her sole discretion. No reason is required to be given. If payment has already been made at the time of a declined application, a full refund will be issued.
Account Registration and Responsibilities
When you create an account with Kate Wand Vocal Coach, you agree to:
- Provide accurate, current, and complete information during registration
- Maintain the confidentiality of your password and account information
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
- Agree that you are at least 18 years old or have parental consent to use our services
We reserve the right to suspend or terminate your account if you violate these terms or if we believe you are misusing our services.
Payment Terms and Billing
Payment for our services is processed through Stripe. By purchasing a service, you authorize us to charge your payment method. The following payment terms apply:
- One-Time Purchases: Pro Voice Analysis, Live Session, and Cohort program purchases (including deposits and balance payments) are charged once at checkout. These services are not subscriptions and do not renew.
- Subscription Billing: Async Coaching renews automatically each month on the date you subscribed. 1:1 Coaching is billed on a weekly or monthly cadence as agreed at the start of your engagement and renews on that cadence. You will be charged the agreed price each billing period unless you cancel (subject to any minimum commitment).
- Billing Information: You authorize us to bill your chosen payment method for all purchases and subscription renewals. Applicable taxes are calculated and collected automatically at checkout where required.
- Price Changes: We reserve the right to change service prices with thirty (30) days' notice. Your continued use of a subscription service after notification constitutes acceptance of the new price.
- Cancellation of Subscriptions: You may cancel an Async Coaching subscription at any time, with no minimum commitment. Cancellation takes effect at the end of your current billing period.
- 1:1 Minimum Commitment: 1:1 Coaching includes a minimum commitment of three (3) months from the start of your engagement. Cancellation before the end of that period is not permitted except in exceptional circumstances at Kate Wand's discretion.
- Grandfathered Rates: Clients who were accepted into the 1:1 coaching programme prior to 12 May 2026 — including those currently in the onboarding process — continue at their originally agreed session rate for the duration of their engagement. The updated rate of $135/session applies to new clients only.
Intellectual Property Rights
All coaching materials, course content, videos, articles, and other educational materials provided by Kate Wand Vocal Coach are the intellectual property of Kate Wand Vocal Coach and Very Opinionated Ltd. These materials are protected by copyright law. You agree not to reproduce, distribute, transmit, display, or perform any of this content without the prior written permission of Kate Wand Vocal Coach.
You are granted a limited, non-exclusive, non-transferable license to access and use the content for your personal, non-commercial use. This license does not permit you to:
- Share, resell, or distribute the content to others
- Create derivative works based on the content
- Use the content for commercial purposes
- Remove or alter any copyright or proprietary notices
User Content and Vocal Recordings
When you submit vocal recordings or other content for coaching or analysis, you grant Kate Wand Vocal Coach a non-exclusive license to use that content for the following purposes:
- Providing coaching and feedback to you
- Improving our coaching methods and services
- Training and development of coaching materials (with your explicit consent)
You retain ownership of your recordings and agree that Kate Wand Vocal Coach will not publicly distribute your recordings without your explicit written consent. We will keep your vocal recordings confidential and secure.
Limitation of Liability and Medical Disclaimer
Kate Wand Vocal Coach provides educational coaching and guidance on vocal technique. The services offered are for educational purposes only and are not a substitute for professional medical advice. Vocal coaching is not medical treatment.
Important: If you experience pain, discomfort, or voice health concerns, you should consult a qualified healthcare provider or laryngologist. Kate Wand Vocal Coach is not responsible for any voice-related health issues. Always seek professional medical advice for health concerns.
To the fullest extent permitted by law, Kate Wand Vocal Coach and Very Opinionated Ltd are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the services, including but not limited to damages for loss of profits, data, or other intangibles.
Prohibited Conduct
You agree not to:
- Use the services for any illegal purpose or in violation of any applicable laws
- Harass, abuse, or threaten any person or entity
- Attempt to gain unauthorized access to our systems or accounts
- Transmit viruses, malware, or any code of a destructive nature
- Engage in any form of spam or unsolicited communications
- Impersonate any person or entity
- Share your account credentials with others
Termination of Service
Either you or Kate Wand Vocal Coach may terminate your account and access to the services at any time, with or without cause, upon written notice. Upon termination:
- Your right to access and use the services immediately ceases
- You must delete all downloaded course materials as directed by us
- You remain responsible for charges incurred up to the termination date
- Certain provisions of this agreement (including limitation of liability) will survive termination
Governing Law
These Terms of Service are governed by the laws of Ontario, Canada, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising from or relating to these terms shall be exclusively brought in the courts located in Ontario, Canada, and you consent to the jurisdiction and venue of such courts.
Disclaimer of Warranties
The services are provided "as is" and "as available" without warranties of any kind, either express or implied. We make no warranty that the services will be uninterrupted, error-free, or free from harmful components. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
Severability
If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Kate Wand Vocal Coach regarding your use of our services and supersede all prior agreements and understandings.
