Acceptance of Terms
By accessing and using the Kate Wand Vocal Coach website (kate-wand.com) and services, you accept and agree to be bound by the terms and conditions of this agreement. If you do not agree to abide by the above, please do not use this service. We reserve the right to modify these terms at any time. Your continued use of the website following the posting of revised Terms of Service means that you accept and agree to the changes.
Description of Services
Kate Wand Vocal Coach offers the following services:
- Personal Vocal Analysis (PVA) Subscriptions: Monthly or annual subscription services providing personalized vocal coaching and feedback.
- One-on-One Coaching: Individual coaching sessions and personalized feedback on vocal recordings.
- Digital Courses: Structured courses on vocal technique, performance, and music theory delivered through our learning platform.
- Vocal Lounge Community: Access to the Vocal Lounge community on Kajabi for interaction with other vocal students.
- Educational Content: Free and premium video content, articles, and resources related to vocal technique and improvement.
Account Registration and Responsibilities
When you create an account with Kate Wand Vocal Coach, you agree to:
- Provide accurate, current, and complete information during registration
- Maintain the confidentiality of your password and account information
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
- Agree that you are at least 18 years old or have parental consent to use our services
We reserve the right to suspend or terminate your account if you violate these terms or if we believe you are misusing our services.
Payment Terms and Billing
Payment for our services is processed through Stripe. By purchasing a subscription or course, you authorize us to charge your payment method. The following payment terms apply:
- Subscription Billing: PVA subscriptions renew automatically on the date you subscribed. You will be charged the subscription price each billing period unless you cancel.
- Billing Information: You authorize us to bill your chosen payment method for all purchases and subscription renewals.
- Price Changes: We reserve the right to change subscription prices with 30 days' notice. Your continued use of the service after notification constitutes acceptance of the new price.
- Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.
Intellectual Property Rights
All coaching materials, course content, videos, articles, and other educational materials provided by Kate Wand Vocal Coach are the intellectual property of Kate Wand Vocal Coach and Very Opinionated Ltd. These materials are protected by copyright law. You agree not to reproduce, distribute, transmit, display, or perform any of this content without the prior written permission of Kate Wand Vocal Coach.
You are granted a limited, non-exclusive, non-transferable license to access and use the content for your personal, non-commercial use. This license does not permit you to:
- Share, resell, or distribute the content to others
- Create derivative works based on the content
- Use the content for commercial purposes
- Remove or alter any copyright or proprietary notices
User Content and Vocal Recordings
When you submit vocal recordings or other content for coaching or analysis, you grant Kate Wand Vocal Coach a non-exclusive license to use that content for the following purposes:
- Providing coaching and feedback to you
- Improving our coaching methods and services
- Training and development of coaching materials (with your explicit consent)
You retain ownership of your recordings and agree that Kate Wand Vocal Coach will not publicly distribute your recordings without your explicit written consent. We will keep your vocal recordings confidential and secure.
Limitation of Liability and Medical Disclaimer
Kate Wand Vocal Coach provides educational coaching and guidance on vocal technique. The services offered are for educational purposes only and are not a substitute for professional medical advice. Vocal coaching is not medical treatment.
Important: If you experience pain, discomfort, or voice health concerns, you should consult a qualified healthcare provider or laryngologist. Kate Wand Vocal Coach is not responsible for any voice-related health issues. Always seek professional medical advice for health concerns.
To the fullest extent permitted by law, Kate Wand Vocal Coach and Very Opinionated Ltd are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the services, including but not limited to damages for loss of profits, data, or other intangibles.
Prohibited Conduct
You agree not to:
- Use the services for any illegal purpose or in violation of any applicable laws
- Harass, abuse, or threaten any person or entity
- Attempt to gain unauthorized access to our systems or accounts
- Transmit viruses, malware, or any code of a destructive nature
- Engage in any form of spam or unsolicited communications
- Impersonate any person or entity
- Share your account credentials with others
Termination of Service
Either you or Kate Wand Vocal Coach may terminate your account and access to the services at any time, with or without cause, upon written notice. Upon termination:
- Your right to access and use the services immediately ceases
- You must delete all downloaded course materials as directed by us
- You remain responsible for charges incurred up to the termination date
- Certain provisions of this agreement (including limitation of liability) will survive termination
Governing Law
These Terms of Service are governed by the laws of Ontario, Canada, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising from or relating to these terms shall be exclusively brought in the courts located in Ontario, Canada, and you consent to the jurisdiction and venue of such courts.
Disclaimer of Warranties
The services are provided "as is" and "as available" without warranties of any kind, either express or implied. We make no warranty that the services will be uninterrupted, error-free, or free from harmful components. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
Severability
If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Kate Wand Vocal Coach regarding your use of our services and supersede all prior agreements and understandings.
